It comes after a 500% increase in claims over the past 4 years and concerns raised by the government earlier in the year that restrictions on whiplash claims could result in claims management companies moving onto holiday sickness claims. The SRA subsequently obtained information from a number of practices about how claims were sourced, the fees received and numbers settled, as well as copies of all referral agreements and fee-sharing agreements. It also reviewed template correspondence used in gastric illness claims. The information obtained from these enquiries has been used for the Warning Notice.

The Law Society has issued a practice note about the risks to solicitors posed by this new legislation, which came into force on 30 September.
The SRA has urged all practices to check HM Treasury’s consolidated list of asset freeze targets, which lists designated persons subject to financial sanction under EU or UK legislation.
The practising certificate renewal period opened on Monday 2 October.
